常用法律英语词汇详解
法律，是国家的产物，是指统治阶级(统治集团，就是政党, 包括国王、君主)，为了实现统治并管理国家的目的，经过一定立法程序，所颁布的基本法律和普通法律。下面是常用的法律英语词汇，希望扩大法律相关词汇的童鞋不妨看看!
Concurrent Sentence 合并判决
刑事案中的被告犯了两项或以上的罪名同时成立，但各项罪名的判刑同时执行，例如第一项罪的判刑是一年监禁，而第二项罪的判刑是监禁两年，两项罪合并判决，被告只需要被服刑两年。
Consecutive Sentence 连续判决
刑事案中的被告所犯的不同罪行，是以连续判决执行，则被告需要分别服刑，例如一项罪被判了两年，另一项罪则被判了三年，被告便需要连续服刑五年，才会被释放。
Consideration 约因
合约是订约方自愿建立的法律关系，是一方以有价值的代价或者承诺以换取对方的承诺或代价，这些合约中的承诺或代价称为约因，缺乏有效的约因，合约便不能成立。
Contributory Negligence 分担疏忽
意外中的伤者对意外的造成及他自己的受伤程度，需要分担部份疏忽的责任，他所获得的`赔偿额也会相对地减少。
Copyright 版权
是作者对他所创作的作品的发表、翻印、复制等专有权利，版权在作品完成后便自动产生及受法律保护，毋须经过任何注册程序，但必须为原创作品才拥有版权。
Counterclaim 反申索
在民事诉讼中，被告对原告作出申索，而该申索的事实和理据与原告的申索是有关连的，反申索是一项独立的申索，所以原告必须对反申索作出适当的响应，例如进行抗辩等。
Custody 保管，监护，拘留
一般而言，Custody这个名词是指对对象的保管或拥有，但在家事法中，Custody of Children 是指对未成年子女的监护权;而在刑事案件中，则指对被告的拘留。
Decree 法庭判令
法庭聆讯后所作出的判令，可以分成暂时性判令“decree nisi” 和永久性判令 “decree absolute”，常见于离婚呈请的程序。一般而言，法庭颁出decree nisi后，在指定的期限过后，除非收到反对，否则都会颁出永久判令。
Deed 契约
是一种特别的合约，须要经过当事人签署、盖章并送交对方才算有效，契约上的盖章在法律上被视为一种有效的约因。
Defamation 诽谤
非法破坏他人名誉的行为，口头的毁谤和以书面的永久形式诽谤都可以构成民事索偿的理据或者刑事罪行。
Defence 抗辩
刑事或民事案件中的被告，否认有关的指控或申索，同时提出反对的支持事实。
Dependant 受养人
是指某人的某些家庭成员，需要依靠这个人提供的经济来支持生活，如果这个人因意外死亡，他的受养人因而遭受损失，是有权追究责任，要求赔偿有关的损失。
Disclaimer 弃权，否认
是指某人愿意放弃法律上的某项权益，如果这项权益是以书面确认，则这份文件称为Disclaimer。此外，也可以是指对某个声称或指控作出否认的行为。
Discovery of documents 披露文件
在民事诉讼的程序中，原告和被告都需要向法庭及对方披露其所持有关于该案件的所有文件，基于公平、公开和公正的法律原则，是“所有与案有关的文件”都需要披露，而不是只披露对自己有利的文件。
Distraint 封租
租客拖欠租金，业主可以根据租约条文向法庭请求封租令，将租客留在物业中的物品充公拍卖，偿还所拖欠的租金和封租的费用。
Domicile 居藉
是一个人定居的地方，居藉与居所不同，每一个人只可以有一个居藉，但却可以多于一个居所，居藉可以是以出生地为居藉，也可以自行选择移居的居藉，也可以是法律界定的居藉，一个人的法律地位受其居藉影响。
Estoppel 不可反言
是“Stop”的意思，法律上不容许否认经已作出的行为，或者不容许引申某项违反公平原则的争辩。
Ex Parte 单方
在公平的原则下，诉讼的程序一般都是以双方“Inter Parte”形式进行，即是与讼双方同时有机会向法庭作出申辩。但在某些特殊的情况下，例如对申请人有人身或财物安全的迫胁，或者不让对方有机会毁灭证据等，是可以容许以单方形式进行。例如以单方传票向法庭申请禁制令，禁止对方将子女擅自携离香港。
Fiduciary Duty 诚信责任
公司董事和受托人等，因为其身处位置，对委托人或有关的受益人都负有诚信的责任，基本上，诚信责任就是不能以位或权而谋私，凡事均以委托人的利益为前题。
Forthwith 立即
法律书信经常用的副词，是立即的意思，例：The outstanding sum should be settled forthwith. 应该立即清还所欠的款项。其实，所谓立即，可以理解为最短的合理时间。
法律英语的专业术语翻译
英文合同中有一些比较特定的，也就是在其他类型的文章中不容易出现的表达。这些句式和短语在其他文章类型以及日常用语中出现的频率非常之低，以至于当它们出现在英文合同中时，总是给让人一种陌生的感觉。其实，如果你是法律英语专业出身或者经常会有机会接触英文合同，你就会发现这些特定的表达数量并不算多，只是我们很少去归纳和总结而已。现在，我们就来总结一下，也欢迎各位法律英语专业人士来补充。1、In accordance with/pursuant to 依据/依照/按照……的规定合同是当事双方的“法律”。合同的目的在于尽最大可能使合同项下的交易行为依照法律规定或约定来开展，从而双方的交易变得具有可预见性。因此，合同中会经常出现“依据……的约定（规定）来……”的表达。在长期的合同翻译实践中，当需要表达依据时，专业法律人士倾向于使用in accordance with 或pursuant 、In respect of/ in connection with/ with respect to 就……在英语合同的翻译中，我们经常会遇见这样的表达，以表示对相关事物的限定。而在一般的英语文本中，当表达或提及到某一特定的事物时，我们通常会用concerning/regarding/in relation to/relating等。这些词如果放在法律文本中，则会让人感觉比较随意，不像in respect of 那样庄重、正式。3、Except (for)/ unless 除非……；除……外英文合同中经常会对一些例外的情况进行规定，最常见的表达是“除非……另有规定，否则……”，这里最常见的搭配是unless otherwise provided/stipulated, Party A shall not....比如，except as provided/stipulated in Article XXX，我们通常翻译为“除本法第XXX条的规定外”4、Notwithstanding... 无论……如何规定；尽管有……的规定作为介词，notwithstanding在普通的英文文本中很少出现。但其在英文合同中的出现频率却相当高。Notwithstanding的含义和普通英文文章中常见的although/though/even if没有太大分别，最明显的区别在于在法律合同中，notwithstanding中后面常跟名词性短语。比如：Notwithstanding the foregoing，一般翻译为“尽管本合同前述条款有所规定……，但……”5、Provided that... 但（前提）是……Provided that一般在法律合同中会出现在主句的后面，表示一种限定或者是前面主句所存在的条件。法律界通常称这种句子为“但书”（proviso）。6、For the purpose(s) of... 就……而言；在……中这又是一个在英文合同中经常出现的短语，不熟悉法律英语的译者在遇到这个短语时，可能第一个反应就是“为了……目的”。但其实在法律合同中，这个短语的表达其实并非我们想象的那样简单。大家都来擦亮眼睛，看看下面这个句子：FASIMILE SIGNATURES. The signature on this Agreement of any party that is faxed to the other party, will be deemed an original signature for the purpose of enforcement of this Agreement. 请问有多少人看了这个句子，会本能的将for the purpose of理解为“出于……之目的/为了……”？合理的译文：传真签名。通过传真方式发送给另一方的任何一方在本协议上的签署在本协议的实施中将被视为原始签署。For the purpose this Agreement, all costs of arbitration shall be borne by the losing Party unless otherwise stipulated by the arbitration tribunal.就本协议而言，所有仲裁费用应由败诉方承担，除非仲裁庭另有规定。7、Subject to... 根据……的规定；在不抵触……的前提下；受制于……该短语在法律英文中一般都跟agreement, section, contract等法律文件名称或文件中特定的条款名配合使用。通常可以翻译为“以……为条件”、“根据……的规定”、“在符合……的情况下”、“在不抵触……规定的情况下”等。8、Without prejudice to... 在不影响……前提下；不影响……这个英文法律短语的功能相当于普通英文中的without affecting。与subject to 的用法相同，跟在without prejudice to这个短语之后的通常是一个指代某项法律条款的名词。其所包含的限制含义没有subject to那么强。看看下面这个例句：Without prejudice to section 24, the following shall be treated as properly executed...参考译文：在不影响第24条规定的情况下，以下协议应视为正式签订……。9、Where... 如果……；凡……；……的在普通英文中where通常用来引导地点状语从句或定语从句，但在法律英文中它常用于引导条件状语从句。其意义相当于in the case，即“凡……”、“如……”。法律合同翻译犹如浩瀚的海洋，唯有在翻译的过程中抱着一丝不苟的态度，勤于查询、勤于积累并能够不断的消化和吸收，我们才能够自在徜徉并有信心为客户带来最优质的翻译作品。编者注：以上内容由译锐翻译编辑整理自《英文合同的翻译与起草》，作者：王相国；

法律英语专业
修个双学士比较好，修法学的。去年据说法学综合排名已经是全国第二了。英语师资没听说过啥优势~只有一个法律英语的叫沙丽金的貌似比较牛一些。其它基本靠自己。都是考证什么的。修了双学士考研的时候就不要在学英语比较好，去学个国际法啥的，都还不错。
为什么选择在西南政法大学读研英语，原因如下:主要是法学，英语相对简单。法律英语专业本身也是属于新兴的、稍微边缘的专业，全国也没几所学校有这个专业，自然学院人数也比较少。学科比较前沿，学术研究的数量目前相比较其他专业，还不是特别多，所以论文找题目比较容易，还是有很多方面可以写的，而且你会发现之前写过相关内容的人也不是很多，还有很多内容需要研究、探讨。法律英语，我个人认为和一般的英语，是有很大区别的，词汇、语法等等都不一样，你随便拉一个英语native speaker，如果没受过很好的教育，是基本看不懂一篇英语的法律文章的。而且，一般英语专业毕业的，即便过了专八，或者托福、雅思什么高分的，如果没有足够的法律知识背景或者法律英语知识，直接翻译一篇专业的法律文章（不论中翻英，还是英翻中），大概率是会出现很多错误的，尤其是在对法律概念的处理上。很多专业法律人士，英语水平比较高的，翻译法律著作，都容易出现错误。你如果日后有机会去听宋雷老师的课程，自然会听到不少。不过，不知道宋老师他现在是否还在代课。个人认为要想在法律英语的专业达到一定水平，那是比较困难的，因为你不仅英语水平、语言学水平、翻译水平等等要达到一定高度，法律背景知识（中国法律、外国法律都包括）也要相当丰富。而且说实话，知识内容的确是深似海。就像宋雷老师说的，如果把法律英语的知识领域比作是26个英文字母，他觉得他学了这么多年，也就学了两个半（记忆中他说的是两个半，也可能是三个或三个半，具体记不清了，反正很少）。像我这种估计就A字左侧那一笔，甚至不到。再说就业方向。我个人感觉（没查询官方统计）大部分毕业生的就业方向，可惜，基本不包含法律英语专业研究。其实这个行业还是需要很多人进行研究的，不过很多法律专业的人士也在做着贡献。多数毕业生就业的方向是三大类：一、法律行业；二、教育行业；三、翻译行业。
法律英语翻译是指法律界通用的书面英语(包括法律、法规、条例、规章、协定、判决、裁定等)，尤其是指律师起草法律文件(合同、章程、协议、契约等)惯常使用的语言。法律英语有其自身的特点，词语、词义、专业用语和表达方式有别于普通英语，形成了一种特殊的文体。所谓“法律界通用的书面英语”，也就是正式文书中官方英语的使用方式，通俗一点可以形容为“不会说人话”——因为在法律英语中，一个突出的特点是不断嵌套从句，冗杂的一句话表达平时四五句话的信息量，因此容易遗漏信息;另外使用我们平时熟悉但意思有变化的词汇，比如“转让”用“transfer”，“对价”用“consideration”，而“关于”又一般不用“about”。因为法律英语的特点(信息量大且复杂，熟悉词汇陌生用法)，律所笔译考试中，最关键考察的就是两个点——无错译-尤其是专业词汇翻译准确无漏译-特别注意修饰从句的漏译做好法律翻译及写作，不仅在于一朝一夕的积累，更在于正确的方法和实践的演练，这也是实践学习中需要掌握的，比如下面这些例子All the materials have been reviewed.“我们已经审阅过所有材料。”——错误在哪儿?多了主语，被动语态常用，并不清楚审阅的主体。参考翻译：“所有材料已经审阅完毕。”We appreciate the open and constructive dialogue regarding the Potential Transaction.需要注意的是，为了句子通顺我们可以进行适当的补充，但要用括号表示出来。参考翻译：“我们对就潜在交易(与贵司)进行的开放性和建设性对话表示感谢。”The Seller will not make or give any representation of quality, express or implied, value, or condition of such assets, provided that the Seller will warrant (a) … (b) …. Concurrent Sentence 合并判决
刑事案中的被告犯了两项或以上的罪名同时成立，但各项罪名的判刑同时执行，例如第一项罪的判刑是一年监禁，而第二项罪的判刑是监禁两年，两项罪合并判决，被告只需要被服刑两年。
Consecutive Sentence 连续判决
刑事案中的被告所犯的不同罪行，是以连续判决执行，则被告需要分别服刑，例如一项罪被判了两年，另一项罪则被判了三年，被告便需要连续服刑五年，才会被释放。
Consideration 约因
合约是订约方自愿建立的法律关系，是一方以有价值的代价或者承诺以换取对方的承诺或代价，这些合约中的承诺或代价称为约因，缺乏有效的约因，合约便不能成立。
Contributory Negligence 分担疏忽
意外中的伤者对意外的造成及他自己的受伤程度，需要分担部份疏忽的责任，他所获得的`赔偿额也会相对地减少。
Copyright 版权
是作者对他所创作的作品的发表、翻印、复制等专有权利，版权在作品完成后便自动产生及受法律保护，毋须经过任何注册程序，但必须为原创作品才拥有版权。
Counterclaim 反申索
在民事诉讼中，被告对原告作出申索，而该申索的事实和理据与原告的申索是有关连的，反申索是一项独立的申索，所以原告必须对反申索作出适当的响应，例如进行抗辩等。
Custody 保管，监护，拘留
一般而言，Custody这个名词是指对对象的保管或拥有，但在家事法中，Custody of Children 是指对未成年子女的监护权;而在刑事案件中，则指对被告的拘留。
Decree 法庭判令
法庭聆讯后所作出的判令，可以分成暂时性判令“decree nisi” 和永久性判令 “decree absolute”，常见于离婚呈请的程序。一般而言，法庭颁出decree nisi后，在指定的期限过后，除非收到反对，否则都会颁出永久判令。
Deed 契约
是一种特别的合约，须要经过当事人签署、盖章并送交对方才算有效，契约上的盖章在法律上被视为一种有效的约因。
Defamation 诽谤
非法破坏他人名誉的行为，口头的毁谤和以书面的永久形式诽谤都可以构成民事索偿的理据或者刑事罪行。
Defence 抗辩
刑事或民事案件中的被告，否认有关的指控或申索，同时提出反对的支持事实。
Dependant 受养人
是指某人的某些家庭成员，需要依靠这个人提供的经济来支持生活，如果这个人因意外死亡，他的受养人因而遭受损失，是有权追究责任，要求赔偿有关的损失。
Disclaimer 弃权，否认
是指某人愿意放弃法律上的某项权益，如果这项权益是以书面确认，则这份文件称为Disclaimer。此外，也可以是指对某个声称或指控作出否认的行为。
Discovery of documents 披露文件
在民事诉讼的程序中，原告和被告都需要向法庭及对方披露其所持有关于该案件的所有文件，基于公平、公开和公正的法律原则，是“所有与案有关的文件”都需要披露，而不是只披露对自己有利的文件。
Distraint 封租
租客拖欠租金，业主可以根据租约条文向法庭请求封租令，将租客留在物业中的物品充公拍卖，偿还所拖欠的租金和封租的费用。
Domicile 居藉
是一个人定居的地方，居藉与居所不同，每一个人只可以有一个居藉，但却可以多于一个居所，居藉可以是以出生地为居藉，也可以自行选择移居的居藉，也可以是法律界定的居藉，一个人的法律地位受其居藉影响。
Estoppel 不可反言
是“Stop”的意思，法律上不容许否认经已作出的行为，或者不容许引申某项违反公平原则的争辩。
Ex Parte 单方
在公平的原则下，诉讼的程序一般都是以双方“Inter Parte”形式进行，即是与讼双方同时有机会向法庭作出申辩。但在某些特殊的情况下，例如对申请人有人身或财物安全的迫胁，或者不让对方有机会毁灭证据等，是可以容许以单方形式进行。例如以单方传票向法庭申请禁制令，禁止对方将子女擅自携离香港。
Fiduciary Duty 诚信责任
公司董事和受托人等，因为其身处位置，对委托人或有关的受益人都负有诚信的责任，基本上，诚信责任就是不能以位或权而谋私，凡事均以委托人的利益为前题。
Forthwith 立即
法律书信经常用的副词，是立即的意思，例：The outstanding sum should be settled forthwith. 应该立即清还所欠的款项。其实，所谓立即，可以理解为最短的合理时间。
